The National Consumer Tribunal, having considered evidence relating to conduct regulateJ by the National Credit Act ("the Act"), namely:
Compelling the Respondent to comply with the Compliance Notice issued to the Applicant due to the
Respondent's failure to comply therewith,
The Tribunal therefore found the following: l

(a) The Respondent is guilty of prohibited conduct in that it contravened Section 100(1)(a) of the Act
(b) lnterdicting the Respondent from future breaches of the NCA

(c) Ordering the Respondent to comply with the Compliance Notice issued by the Applicant on 12
September 2016 and in terms of Section 55(1) of ihe NCA by not later than 31 August 2017,
 
The finding is based on the following grounds:
An investigator in the employ of the National Credit Regulator visited the Respondent's premises unannounced on 10 June 2014 and interviewed the CEO, a certain Mr Dawie Botha, The lnvestigator found that Respondent contravened Section 100(1) (a) of the National Credit Act by charging consumers a "Debt Administration Service Charge" in some agreements, also called a "Service Charge". These aliegations and documentary evidence put fonruard by the National Credit Regulator provides proof on a balance of probabilities of the allegations made against the Respondent and further, stands uncontroverted by the Respondent,
